The test of employment is complicated and even if a contract specifically states that the situation is not an employment relationship, the courts will look behind the contract. In some cases employment law actually applies before the employment has commenced. The job applicant, who thinks he or she has been the subject of discrimination or adverse action, can make a complaint and initiate proceedings against a business, even if they did not get the job applied for.
